Contesting a contravention

Under articles 31-36 of Government Ordinance 2/2001, any contravention report can be challenged by filing a written contestation with the local court within 15 days of receipt. The procedure is exempt from court fees and the contestation, if filed in time, automatically suspends the enforcement of the fine. The court summons the issuing officer and the petitioner, administers evidence and may annul the report, replace the fine with a warning, or reject the contestation. The judgment is final for small fines or can be appealed to the tribunal within 30 days for fines above 4,000 RON for individuals or 6,000 RON for companies.
