Staying enforcement of a Romanian judgment
A stay of enforcement is obtained from the court that approved it, through a contestation accompanied by a stay request and the payment of a bond.
Staying enforcement
Article 719 of the Romanian Code of Civil Procedure allows the debtor or any prejudiced third party to obtain a stay of enforcement of a judgment. The request is filed together with a contestation against enforcement, before the court that approved the enforcement. A bond must be paid, calculated as a percentage of the contested amount, ranging from 10% for small claims down to 0.1% for very large ones. In urgent cases, a provisional stay can be obtained immediately, in chambers, with a reduced bond. While the stay is in force, the bailiff cannot continue any enforcement act, although measures already taken remain valid until the contestation is resolved. The order can be appealed within 5 days.
