Child support in Romania — how it is calculated
Child support in Romania is set as a percentage of the obligor parent's net income: 25%, 33% or 50%, depending on the number of children.
How much child support?
Article 529 of the Romanian Civil Code caps child support at a share of the obligor parent's net income: up to 25% for one child, 33% for two and 50% for three or more. The application is filed at the local court (judecătorie), exempt from court fees. If the parent has no declared income, support is calculated against the minimum wage.
Unpaid child support may be recovered through enforcement (wage garnishment). Wilful non-payment for more than three months is the criminal offence of family abandonment (art. 378 of the Criminal Code), punishable by 6 months to 3 years in prison.
