Judicial expert report in Romania: when ordered and how it affects the ruling

A judicial expert report analyses technical or financial matters at the court's request. Conclusions can be decisive but the judge weighs them alongside other evidence.

What is a judicial expert report?

Under art. 330-340 NCPC, the court appoints an authorised expert to analyse technical, financial or medical matters. The court sets the questions (obiective). Parties may appoint counter-experts. The advance fee is paid by the requesting party. The report is not binding: the judge weighs it with other evidence. Parties may file objections; the court may order a supplemental report. In complex technical cases, the expert opinion is typically decisive in practice.
