Waiver of the Right of Withdrawal (historical document)

Version 1.6 · Effective date: 1 October 2026

Requested for acceptance between 19 July and 27 August 2026. Retained under Art. 7(1) GDPR (demonstrating consent) and art. 1183 Romanian Civil Code.

This document is no longer requested from anyone

Since 27 August 2026, StatusDosar.ro no longer asks anyone to waive the statutory right of withdrawal, neither at account registration, nor at the moment of payment. There is no waiver checkbox anywhere on the Platform. The page is kept published because acceptances were given under it while it was requested, and those acceptances must remain readable by the people who gave them.

What applies today is written in the Terms and Conditions (Art. 6.6-6.7) and in the Refund and Cancellation Policy (Art. 2.4, 3.1).

Art. 2. What this document was

2.1. Between 19 July and 27 August 2026, this page was a separate legal document, presented for acceptance through a dedicated checkbox, distinct from the others and not pre-ticked, in the legal-documents acceptance dialog at account registration and at the re-acceptance of updated documents.

2.2. Through it, the consumer gave the express prior consent that, upon a future paid activation of a subscription, performance of the digital service would begin immediately upon payment confirmation, and acknowledged that they thereby lost the statutory 14-day right of withdrawal for that paid activation. That is the mechanism of the exception in art. 16 letter m) GEO 34/2014: it applies only where the trader asks for both the express prior consent and the acknowledgment.

2.3. From 29 July 2026 the acceptance given at registration was accompanied by a second, separate confirmation, not pre-ticked, requested at the moment of each payment. That second confirmation was removed from the product on 14 August 2026, and the acceptance at registration on 27 August 2026. Neither is requested any more.

Art. 3. Why it is no longer requested

3.1. The Provider decided to stop asking consumers to give up a right. Nothing was put in the place of the waiver: it was removed, and what remains is a right granted in addition: the full refund of the amounts paid, which may be requested within 15 days of the first payment (Refund and Cancellation Policy, Art. 2.3; Terms, Art. 5.3).

3.2. The consequence is stated plainly, including the part that does not favour the Provider: without an express waiver, the exception in art. 16(m) GEO 34/2014 is not available to us. The Provider therefore does not invoke it and does not claim that any consumer has lost the statutory right of withdrawal. The rights the law grants remain as the law grants them.

3.3. The standard withdrawal form required by art. 9 GEO 34/2014 is made available in the Refund and Cancellation Policy, Art. 7bis, without the reservation that this document used to place on it.

Art. 4. What this means if you accepted it

4.1. Your acceptance remains recorded, and readable. If you accepted this document while it was requested, that acceptance stays in your account's consent history, with the date and time, the version accepted and the technical context of the request, and you can export it at any time from your profile (Art. 20 GDPR). Nothing has been deleted or rewritten: the Provider must be able to demonstrate the consents it collected (Art. 7(1) GDPR), and this page remains published so that what you accepted stays readable to you.

4.2. The Provider no longer invokes that waiver. From 1 October 2026, the Provider does not rely on the waiver given under this document against any User, and does not invoke the exception in art. 16(m) GEO 34/2014 on its basis. This is deliberate: a document that asks nothing of new consumers, while a waiver was still held against older accounts, would have left two different regimes for the same service. There is one regime, and it is the one in the Terms (Art. 6.7).

4.3. You have nothing to sign. The removal of this requirement takes nothing away from anyone, so it does not trigger any re-acceptance: no account is asked to accept anything because of this change.

Art. 5. Versions of this document

Each version of this document has its own version number, and acceptances already given remain attached to the version accepted at the time. Since it is no longer presented for acceptance, a new version of this page no longer triggers any re-acceptance. Historical versions and their effective dates are kept in the Provider's internal register and are available on request through the DPO form.

Art. 6. Where the rules in force are written

This document is no longer part of the contractual set (Terms and Conditions, Art. 15.3). What applies to a payment made today is written in the Terms (Art. 5.3, the 15-day refund; Art. 6.6-6.7, refunds and the absence of any waiver), in the Refund and Cancellation Policy (Art. 2.3, 2.4, 3.1 and the standard form in Art. 7bis) and in the Online Card Payments document (section 7).
