What is a judicial settlement?
Under art. 438–441 NCPC, parties may end litigation through mutual concessions confirmed by the court. The court issues a ruling (hotărâre de expedient) that constitutes an enforceable title — it can be enforced without further proceedings. The court fee is 50% reimbursable. The court verifies legality but does not examine the merits. Distinguished from achiesare, which is unilateral recognition by the defendant.
