What does suspension of proceedings mean in Romanian courts
Suspension of proceedings means the case is temporarily frozen: no hearings are scheduled, no procedural acts performed. Causes range from party agreement to the death of a party.
Definition
What does suspension mean?
Under art. 411-415 NCPC, suspension temporarily halts the case. No hearings are scheduled and no procedural acts are performed. It may be mandatory (automatic by law) or discretionary (court or parties' request).
How is the case resumed?
Either party may file a motion to resume once the cause of suspension ceases. If neither party acts within 6 months, the case may be extinguished by abandonment (perimare, art. 416 NCPC): though the underlying right is preserved.
