Transfer of venue (strămutare) in Romanian civil procedure
Transfer of venue moves a case to another court of the same level for reasons of impartiality or public order. It is requested from the hierarchically superior court.
Definition
What is strămutare?
Under art. 140-147 NCPC, a case is transferred to another court of the same level when there are objective reasons to doubt impartiality (bănuială legitimă) or when public order would be threatened. The request is filed with the court of appeal (for first-instance cases) or ICCJ (for appeal-level cases). Acts performed before transfer remain valid. The transfer ruling is final and unappealable. Unlike declinare, the original court is competent: strămutare addresses impartiality, not jurisdiction.
