Precautionary seizure (sechestru asigurător) in Romanian civil procedure

Precautionary seizure freezes the debtor's movable or immovable assets during litigation to ensure there is something to enforce against if the creditor wins.

What is sechestru asigurător?

Under art. 952–959 NCPC, precautionary seizure freezes the debtor's assets during litigation. Granted ex parte (without citing the debtor). A bond may be required from the creditor. Seized assets cannot be validly alienated. On real estate, recorded in the land registry. If the creditor loses on the merits, seizure is lifted and damages may be claimed. Compare with poprire, which freezes monetary claims.
