Reinstatement of deadlines

Article 186 of the Romanian Code of Civil Procedure allows a party who missed a procedural deadline for a duly justified reason to be reinstated. The request must be filed within 15 days after the impediment ceased, together with the procedural act itself (appeal, recourse, etc.). The applicant must prove the impediment. Courts have accepted serious illness, hospitalization, natural disasters or wrongly communicated decisions as valid grounds; mere negligence, ignorance of the law or lack of funds are not. If granted, the act is treated as filed in time. Reinstatement is decided with priority by the court competent to hear the underlying act.
