Case abandonment (perimare) in Romanian civil procedure
Perimare extinguishes a civil case if no party takes procedural steps for 6 months. The underlying right survives, but the case is closed.
Definiţie
What is perimare?
Under art. 416–422 NCPC, a civil case is extinguished (perimată) if no party takes procedural steps for 6 months. The court may declare perimare on its own motion or at a party's request. The underlying substantive right survives — a new action may be filed if the limitation period has not expired.
The 6-month clock runs from the last procedural act taken at a party's initiative. Court-initiated acts (scheduling orders, citations) do not interrupt it. The period is suspended during mandatory suspension of proceedings.
