Amending the statement of claim in Romanian civil procedure

A Romanian claimant may amend the statement of claim only until the first hearing, in writing, under penalty of forfeiture.

Amending the statement of claim

Under article 204 of the Romanian Code of Civil Procedure, a claimant may amend their statement of claim only until the first hearing at which they are duly summoned. After that, amendment is allowed only with the express consent of all parties or for material error correction. Increasing or decreasing the amount claimed, asking for the value of a lost item or replacing a declaratory request with a coercive one are not considered amendments and can be done at any time. The amendment must be filed in writing, with the supporting documents and additional court fees, and is communicated to the defendant who receives a new deadline for the statement of defence. Amendments are forbidden in appeal under article 478.
