Severance of claims (disjungere) in Romanian civil procedure
Severance means the court separates one claim and judges it in a new, independent case. It occurs when one claim is more complex or would delay adjudication of the others.
Definition
What is disjungere?
Under art. 139 para. 5 NCPC, the court may sever a claim from the main action and register it as an independent case with a new number. This is the reverse of conexare. The severed case remains with the same panel. Procedural acts performed before severance remain valid. A new case number will appear on portal.just.ro: monitor it separately.
Frequently asked questions
No. The severance order (încheiere) may only be challenged together with the final judgment, not independently.
