Nullity complaint (contestație în anulare) in Romanian civil procedure

Nullity complaint challenges final judgments for serious procedural errors — especially illegal citation or omission of a recurs ground. It is not a re-examination of the merits.

Definiţie

What is contestație în anulare?

Under art. 503–507 NCPC, a nullity complaint challenges a final judgment for serious procedural errors: illegal citation, lack of jurisdiction, or (in recurs cases) failure to examine a raised ground. The deadline is 15 days from communication, with a 1-year outer limit. The same court that issued the judgment hears the complaint. If admitted, the judgment is set aside and the case is retried. Enforcement is not automatically suspended. Compare with revizuire, which addresses substantive grounds.
