Service by publication

Article 167 of the Romanian Code of Civil Procedure allows summoning a party by publication when the claimant proves that, despite reasonable efforts, the defendants address could not be found. The court orders the citation to be displayed at its premises and at the last known address, published in a broad-circulation newspaper and, in important cases, in the Official Gazette. Service is deemed accomplished 15 days after publication. The court also appoints a special curator from the local bar to defend the absent partys interests, whose fee is advanced by the claimant. If service by publication was obtained fraudulently, the resulting judgment can be annulled and the claimant fined.
