Plea agreement in Romanian criminal procedure

A plea agreement lets the defendant negotiate the sentence with the prosecutor in exchange for admitting guilt. The penalty is reduced by one third.

Introduced in 2014, the plea agreement (art. 478-488 CPP) allows the prosecutor and the defendant to negotiate the sentence directly. The defendant must admit the offence and legal classification in full. In return, the statutory penalty range is reduced by one third for imprisonment and one quarter for fines.

The agreement is admissible only for offences punishable by up to 15 years in prison. The court reviews it and may either confirm or reject if the proposed sentence is manifestly too lenient. Mandatory legal assistance applies.
