Acknowledgement of claims (achiesare) in Romanian civil procedure

Achiesare means the defendant fully or partially acknowledges the claimant's claims. The court takes note and rules in the claimant's favour without examining the merits.

Definition

What is achiesare?

Under art. 436-437 NCPC, the defendant acknowledges the claimant's claims in whole or in part. The court takes note and rules in favour of the claimant without examining the merits. Unlike judicial settlement, achiesare is unilateral: only the defendant makes a concession. The defendant who has acknowledged a claim may no longer appeal that part of the ruling (art. 463 NCPC).
