The Romanian Civil Procedure Code (art. 1.034-1.049) provides a special fast-track eviction procedure. Before filing, the landlord must serve a written eviction notice via bailiff or registered letter, granting at least 30 days to vacate. If the occupant ignores it, the landlord files the eviction action at the local court (judecătorie).
The case is heard urgently in chambers. The defendant can only raise defences relating to their own right to occupy. The judgment is enforceable by law — no separate enforcement order is required — and eviction can take place 5 days after communication. Appeal is possible within 5 days but does not suspend enforcement. Unpaid rent is recovered through a separate procedure.
