Definiţie

Judicial control in Romanian criminal procedure

Judicial control (art. 211-217 CPP) is a non-custodial preventive measure. The suspect remains free but must report to the police, notify any change of address and may be subject to additional obligations: a travel ban, no contact with witnesses or victims, surrender of passport, electronic monitoring or driving prohibition.

It is ordered by the prosecutor during investigation (challengeable within 48 hours) and by the judge thereafter. Wilful breach can lead to escalation to house arrest or pre-trial detention. A "control judiciar pe cauțiune" variant allows release on a financial guarantee.
