Protection order in Romania — how to obtain it

A protection order is a court measure barring the abuser from contacting the victim of domestic violence. It is issued by the local court within 72 hours.

What is a protection order?

Under Law 217/2003, a Romanian court can issue a protection order banning an abuser from approaching the victim of domestic violence within 72 hours of filing. The application is free of court fees. The order may force the abuser to leave the shared home (even if owner), keep a 200 m distance and surrender lawfully held weapons. Maximum duration is 6 months, renewable.

Police may issue a 5-day provisional protection order on the spot in emergencies, then refer the case to the prosecutor for court confirmation. Breach of a protection order is itself a criminal offence punishable by 1 month to 1 year of imprisonment.
