Guardianship for minors is opened when parents are deceased, removed from rights or missing, and the court appoints a guardian.

Articles 110-163 of the Romanian Civil Code regulate guardianship for minors who lost parental protection: both parents deceased, removed from parental rights, missing or unable to exercise rights. The guardianship court at the minors domicile appoints a guardian after hearing the proposed person, the minor over 10 and close relatives, with mandatory prosecutor participation. The guardian raises the minor, represents them in legal acts up to age 14 and approves their acts between 14 and 18, manages their property and submits an annual report to the court. Major acts of disposal (selling real estate, taking loans, renouncing inheritance) require court approval. Guardianship ends at 18, on the minors death or on early marriage.
