Private signed document in Romanian evidence law

A private signed document is a written act signed by the parties without notarisation, with full evidentiary value unless challenged.

Definiţie

Private signed document

Articles 272-282 of the Romanian Code of Civil Procedure and 1.182-1.186 of the Civil Code govern private signed documents — written acts signed by the parties without notarisation. They have full evidentiary value against the signatories and their heirs until proven otherwise. Synallagmatic contracts must be made in as many originals as there are parties with conflicting interests (multiple-original rule). Promises to pay a sum must include the amount written by hand or be preceded by the note "good and approved for ...". A private document acquires a certain date against third parties only when notarised, registered with a public authority, mentioned in an authentic act, or when one signatory dies. The signature can be challenged, in which case the court orders a handwriting expertise.
